Service Policies for The Communication Initiative Transactions The purpose of this section is to outline the "Terms and Conditions" for people and organisations using The Communication Initiative's fee based and related services such as Development Classifieds. Use of The CI's services amounts to acceptance of these Terms and Conditions. The Communication Initiative reserves the right to update and change the paragphs and clauses in this section at any time and without notice. It is user responsibility to regularly review these terms and conditions. The Communication Initiative is unable to control and/or verify the knowledge submitted by users on The CI online platform and has no legal requirement or obligation to undertake such controls or verification. The company requests that all people accessing and using the Development Classifieds and other CI processes be cautious and aware that inaccurate submissions may have been made by users. User AccessIt is the obligation and responsibility of all people and organisations using these CI services to ensure that their registration user name[s] and password[s] remain confidential, to be diligent in their use of those access permissions and to contact The Communication Initiative as soon as they become aware of any issues relating to improper or unauthorised use of access permissions, providing details of those issues and concerns. The Communication Initiative LiabilityThe CI online platform provides a place and space for people involved in international development action to advertise and promote their work [eg books], services [eg training] and employment opportunities [eg job vacancies]. The Communication Initiative is not involved in any transaction between parties that identify each other through The Communication Initiative platform. Those are specific agreements between the advertising/promoting party and the people interested in the services or opportunities being promoted. As this process is based on knowledge submitted by the advertising/promoting party The Communication Initiative has neither a role not control over the legality, safety, quality, accuracy and truth of the knowledge and other information submitted and communicated through Development Classifieds. As a result The Communication Initiative cab also neither guarantee nor take responsibility for any mistakes, errors or omissions within the knowledge communicated. The Communication Initiative (comminit.com) does not and will not provide professional advice and guidance of any kind related to the subject and focus of the specific knowledge submitted through and fee based transaction on The Communication Initiative platform. Because user authentication on the Internet is difficult, the Company cannot and does not confirm that each user is who they claim to be. In the event that there is a dispute with one or more users, users release the Company (and agents and employees) from claims, demands, and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. The Communication Initiative has not a partner to, has no role within and no responsibility for any decisions taken by other organisations based on knowledge communicated or connections made through The Communication Initiative platform. Web Related IssuesThe Communication Initiative can not guarantee that its online platform processes will operate in an error-free manner. The CI is not responsible for any costs that you may incur - for example software or hardware replacement - as result of any issues that emerge and may be connected to malfunctions and problems with the operation of The CI online platform. All users accept this platform in that state they find it on accessing and using - including all risks normally associated with web based processes including viruses, spam and other harmful intrusions. Refund RequestsThe Communication Initiative is most grateful for the opportunity to support your important work. Ensuring that those who use The CI Development Classified services are satisfied with the support that they receive is vitally important to us. We take all refund requests and issues very seriously. Conditional upon the facts and specific circumstances related to the refund issue and/or request, The Communication Initiative reserves the right to accept or reject any refund request. Removal of SubmissionsIt is the sole responsibility of all users of The CI processes, including direct submitters of knowledge to ensure the content of their submissions for placement on The CI platform are accurate and are not in any way malicious or offensive. The Communication Initiative reserves the right to remove from its platform any submissions which it considers to be inaccurate, malicious or offensive. Damages DisclaimerThere are no circumstance under which The Communication Initiative, its strategic and funding partners or any associated third parties featured on the online platform will be in any way liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost date or business interruption) related to or resulting from people using or attempting to use The Communication Initiative online platform in any form whatsoever IndemnityUsers agree to defend, indemnify, and hold harmless the Company, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from their use of the material or their breach of the terms of these Terms and Conditions. The Company shall provide notice to users promptly of any such claim, suit, or proceeding and shall assist them, at their expense, in defending any such claim, suit, or proceeding. Fees, Payment and CancellationThe following sections of the Communication Initiative website require payment of fees: Vacancies, Associates, Training, Events, Books, RFPs. Users will pay all appropriate fees as described on the web-site in connection with such services selected by the user. The Communication Initiative reserves the right to change it’s fees and/ or implement new charges at any time, upon twenty (20) days prior notice to users, with notice sent by email or posted on The Communication Initiative website. Use of the services by the user, following notification shall be considered acceptance of any new or increased charge. There will be no refunds for the Associates program of The Communication Initiative website. Invoices for the Training/Events/ Materials and Vacancies will be generated online at the time of submission or issued one to three business days after the Information has been posted or uploaded to the web-site. Refunds related to these sections of the website are encompassed under the Refund policy. Refunds will only be offered in situations where there has been a service or support error on the part of the Communication Initiative. Invoice for Associates: Users agree to pay to all charges and fees associated with their username and password (including any applicable taxes) at the rates in effect when the charges were incurred. Unauthorized UseAll knowledge and ideas submitted to and presented through The Communication Initiative online platform are proprietary information to The Communication Initiative. Acceptable UseUsers may not use the Web Site in order to duplicate, distribute, transmit, store or destroy material (a) in violation of any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others, or (c) that is defamatory, obscene, threatening, abusive or hateful. Users are prohibited from copying, duplicating or otherwise reproducing the content of the Company's web site, including, but not limited to, user profile or personal information contained or referred to in the Company's products and services, the analysis and information contained in specific or general project notices and or trend analysis documents, and company, organization, or individual specific information. Users are prohibited from violating, or attempting to violate, the security of the Web Site, including, without limitation: (a) accessing data not intended for such user or logging into a server or account which the user is not authorized to access, (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization, (c) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the Web Site, overloading, "flooding", "spamming", "mailbombing" or "crashing", (d) sending unsolicited e-mail, including promotions and/or advertising of products or services, or (e) forging any TCP/IP packet header or any part of the header information in any e-mail, newsgroup or other posting. Violations of system or network security may result in civil or criminal liability. The Company will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users involved in such violations. TerminationThe Company reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to deletion of a user's material from this Web Site and the immediate termination of a user's registration with, or ability to, access the Web Site and/or any other service provided to the user by the Company upon any breach of these Terms and Conditions. Additionally, a user profile may be deleted if the Company is unable to verify or authenticate any information submitted by the user to the Web Site for registration and/or other informational purpose. |
